A. Established. The Board of Commissioners establishes the Jasper County Community Corrections Donation Fund into which cash donations shall be deposited for the support of the Jasper County Community Corrections Program and its efforts to care for adjudicated offenders and to provide safety and service to the community.

B. Sources of Donations. The sources of the donations to which this chapter applies are local businesses, foundations, trusts, and not-for-profit organizations, for the purpose of assisting in the administration of the Jasper County Community Corrections Program. The sources do not include Federal or State grants for which other accounting measures must be implemented. All of the donations shall be delivered to the Jasper County Auditor to be receipted into the Jasper County Community Corrections Donation Fund.

C. Use of Undesignated Donations. All donations to the Jasper County Community Corrections Donation Fund for which the donor has not designated a specific purpose for the use of the funds can be used by the Director of the Jasper County Community Corrections Program only with the approval of the Jasper County Community Corrections Advisory Board and as appropriated by the Jasper County Council only for the following purposes of the Jasper County Community Corrections Program:

1. For the reduction and/or prevention of criminal or wrongful juvenile activity, including, but not limited to, substance abuse, child abuse, and domestic violence;

2. For restorative justice programs which emphasize victim/offender restitution and reconciliation;

3. For equipment installed in the Jasper County Community Corrections Facility;

4. For other equipment, including, but not limited to, vehicles, and vehicle equipment, computers and software, communications devices, office machinery and furnishings;

5. For housing and feeding persons contracted to provide specialized services, whether for officer/staff training or offender services as nonemployees of the County, limited to two days per occurrence; and

6. For any other purpose that benefits the Jasper County Community Corrections Program that is mutually agreed upon by the Jasper County Council and the Jasper County Community Corrections Advisory Board.

Money disbursed from the fund as hereinabove set forth must be supplemental to or in addition to, rather than a replacement for, the regular appropriations made to carry out the purposes hereinabove set forth.

D. Use of Designated Donations. All donations to the Jasper County Community Corrections Donation Fund for which the donor has designated a specific lawful purpose shall be used for the purpose with the consent of the Jasper County Community Corrections Advisory Board and as appropriated by the Jasper County Council. Any such funds not used as designated by the donor shall be returned to the donor; or reassigned for another use only with the written consent of the donor.

E. Recordkeeping and Accountability. The Director of the Jasper County Community Corrections Program shall maintain a record of the donations and disbursements, which record shall be in a form approved by the Indiana State Board of Accounts. The Jasper County Community Corrections Advisory Board shall provide a copy of the record to the Jasper County Council by December 31st of each appropriate year.

F. The Board of Commissioners elects to allocate 75 percent of all funding that is received back for the detaining of correctional inmates be put into the Community Corrections Fund and to be used exclusively for the funding and operation of a Community Corrections Program.
