A. No employee, officer, or agent of Jasper County shall participate in the selection, or in the award or administration, of a contract if a conflict of interest, real or apparent, would be involved. Such a conflict arises when there is a financial or other interest in the consultant selected for award by: the employee, officer, or agent; any member of his or her immediate family; his or her partner; or an organization that employs or is about to employ any of the above.

B. If a Jasper County project involves a Federal awarding agency, Jasper County must disclose in writing any potential conflict of interest to the Federal awarding agency or pass-through entity in accordance with applicable Federal awarding agency policy.

C. Jasper County’s officers, employees, or agents shall neither solicit nor accept gratuities, favors, or anything of monetary value from consultants, potential consultants, or parties to subagreements. The dollar value of $200.00 per day, below which any financial interest or value of any gratuity is not substantial, may be accepted per this policy.

D. A “consultant” is defined as the individual or firm providing engineering and design related services as a party to a contract with Jasper County. Consultants of Jasper County shall reasonably and in good faith anticipate, identify, and disclose to the Jasper County Board of Commissioners in writing any actual or potential conflict of interest. Said notice shall fully explain the conflict or potential conflict and shall provide any recommendations or protocol to remedy the conflict.

E. Consultants or potential consultants of Jasper County shall not provide Jasper County’s officers, employees, or agents gratuities, favors or anything of monetary value. The dollar value of $200.00 per day, below which any financial interest or value of any gratuity is not substantial, may be given per this policy.

F. Any violation or suspected violation of this policy by Jasper County officers, employees, or agents, or by consultants or potential consultants shall be immediately reported to the Jasper County Board of Commissioners. The Board of Commissioners may meet in executive session pursuant to IC 5-14-1.5-6.1(6) to receive information concerning misconduct.

1. Violation of this policy may result in any one or more penalties, sanctions, or other disciplinary actions against the officer or employee including but not limited to a directive to return of all gifts and benefits either in kind or the equivalent monetary value thereof, censure, reprimand, suspension, and termination of employment.

2. The Board of Commissioners may select from one or more penalties or sanctions against consultants, potential consultants or their agents or employers, including but not limited to ordering the removal of the offending party from current County projects, disqualification of the offending party from bidding or otherwise participating in future County projects, declaring a breach of existing contracts, and cancellation of existing contracts.
